As a seaman, you have certain rights:

  • Your employer must provide you maintenance (payment for daily living) and cure (payment for medical bills.)

  • Your employer must provide transportation to and from Doctor’s appointments if you cannot get there on your own or, provide reimbursement for travel expenses.

  • Your employer must allow you to see any Doctor of your choosing.

  • You may hire any qualified lawyer at no initial cost.

  • Unlike land-based claims, you may bring an action against the insurance company for the vessel’s negligence or unseaworthiness.

As a passenger, you have certain rights and responsibilities:

  • Many passenger tickets have strict guidelines for notice to the vessel owner and for bringing a claim.

  • It is important you speak to a qualified maritime lawyer immediately following an incident aboard a ferry ride, whale watching tour, cruise ship, or recreational vessel.
